Where Do I File for Bankruptcy?
What bankruptcy district you file in depends on what county you have lived in for the majority of the six months’ prior to filing for bankruptcy. For example, if you lived in Ingham County but four months ago you moved to Macomb County, you would file for bankruptcy in the Bankruptcy Court for the Eastern District of Michigan. If you have lived in Eaton County for the majority of the last six months you would file your bankruptcy in the Bankruptcy Court for the Western District of Michigan.
The Bankruptcy Court for the Eastern District of Michigan has two divisions: the Northern Division and the Southern Division. The Southern Division covers the following counties: Genesee, Jackson, Lapeer, Lenawee, Livingston, Macomb, Monroe, Oakland, Saint Clair, Sanilac, Shiawassee, Washtenaw, and Wayne. Within the Southern Division your hearing location is also determined by what county you have lived in for the majority of the last six months. For example, if you live in Oakland County your hearing location will be in Detroit. If you live in Washtenaw County your hearing will be in Ann Arbor. If you live in Genesee County your hearing will be in Flint, and so on.
