USCIS No Longer Accepts Applications for Deportation Deferrals for Immigrants with serious medical Conditions

USCIS has ended a program providing deferrals from deportation for all types of eligible immigrants except for DACA and military requests. Immigrants with serious medical conditions who are seeking treatment in the US are also no longer eligible. These immigrants file applications requesting that they be allowed to stay for a period of time while they seek treatment. The deferral from deportation can be renewed for two-year increments with unlimited number of renewals. Some immigrants have continued long term medical treatments by using this humanitarian program.

However, USCIS has sent out letters to recent applicants indicating that it will no longer accept their applications for deferral from deportation and advises applicants to seek assistance from ICE. ICE has stated that it was surprised by USCIS’ decision and that it does not currently have a program to adjudicate such applications.

As such, it is likely that those who were once eligible for this program may now be placed in deportation proceeds. They may seek any immigration relief for which they are eligible through the deportation process.
