USCIS Makes Changes to the Eb-5 Immigrant Investor Program

USCIS recently announced a new rule to the EB-5 immigrant investor program. The new rule makes several changes to the program, including:

1. Providing the ability for certain immigrant investors to retain the priority date of previously approved EB-5 petitions when filing a new petition.

2. Increasing the standard minimum investment to $1.8 million from $1 million and increasing the Targeted Employment Area (TEA) designated investments to $900,000 from $500,000. Future adjustments to the standard minimum investments will be made every five years based on inflation.

3. TEA designations made by state and local governments will no longer be followed. Instead, USCIS will now directly review and determine whether to designate a certain area as a high-unemployment TEA.

4. Derivative members of a principal EB-5 investor must now independently file to remove conditions on the permanent residence.

5. Other technical changes and updates.

These changes will go in effect on November 21, 2019.
