Changes to Migrant Families Detention Limits

A new regulation was announced by the Department of Homeland Security that would remove limits on detaining migrant families entering from the southern border. The change takes effect in 60 days.

Under the current Flores rule, the government is limited by how long it can hold children or families with children. It can hold them for no more than 20 days.

According to the new regulation, the government will hold the families together in detention for the duration of the adjudication of their case. That could be two months or longer.

It is possible that the new regulation will be challenge in court prior to its implementation.
