Is the Bankruptcy Court Open During the Covid-19 Outbreak?

Bankruptcy cases can still be filed during the Covid-19 outbreak. Most bankruptcy cases are filed electronically and are not impacted by any physical closure of the bankruptcy court. There is a Trustee appointed by the Court to administer your bankruptcy case and question you at your hearing. The Trustee needs to see certain documents relating to your financial affairs. The documents are typically forwarded to the Trustee electronically and are not impacted by any physical closure of the Trustee’s office.

At this time the bankruptcy hearings are being held telephonically. There is a conference line all parties to the bankruptcy case can call in to attend your hearing. You need to e-mail a copy of your driver license (or government-issued photographic identification) and social security card to your bankruptcy attorney in advance of your hearing. This information will allow your trustee to verify your identity at your hearing as required by the bankruptcy court.
