August 2019 Visa Bulletin Continues the July 2019 Priority Date Numbers – Continues to be Very Beneficial to Spouses and Children (under 21) of Green Card Holders
The family based F2A category in the August 2019 visa bulletin remains current since it changed in the July 2019 visa bulletin. This means that anyone who has been waiting to file for an immigrant visa under the F2A category can now file for a visa or adjustment of status. It is important to file the visa application or adjustment of status application right away as It is possible that the category might retrogress.
Furthermore, it is also possible to file a one step adjustment of status application under the F2B category. This means that it is possible for a green card holder to file both an I-130 and I-485 for their spouse while they are in the US, and should the category stay current, they may be able to obtain a green card within a six month timeframe. However, those who apply for a one step adjustment of status application will have to prove that they have lawful status until the case is adjudicated. In other words, they have to be in the US legally throughout the whole time the case is being processed and up until they are granted their green cards.
This is welcome news for those green card holders that have been waiting two or more years for their priority date to become current.
Any person eligible to file for a visa or adjustment of status must do so as soon as possible to take advantage of the F2A category “current” status. The “current” status is expected to retrogress in September or October 2019.
